Terms of Use

These Terms of Use (“Terms”) govern your use of the Simmernook app (“the app,” “we,” “us”). By downloading or using the app, you agree to these Terms. If you do not agree, please don’t use the app.

1. What Simmernook is

Simmernook is a hands-free voice cooking companion that uses an AI service to guide you through recipes, set timers, and answer cooking questions by voice. It is provided for personal, home cooking and general informational purposes.

2. AI guidance is informational, not professional advice

The companionship is generated by an AI model and can be incomplete, inaccurate, or wrong. It is not professional culinary, nutritional, medical, dietary, or food-safety advice, and it is not a substitute for your own judgement or the instructions that come with your ingredients and equipment.

• Do not rely on the app for any decision where an error could cause harm.
• If you have allergies, dietary restrictions, or health conditions, consult a qualified professional and verify ingredients yourself — do not rely on the companion.

3. Food safety is your responsibility

You are responsible for safe food handling and safe use of your kitchen. In particular:

• Follow the food-safety guidance on your ingredients’ packaging — including cooking temperatures, internal-temperature targets, use-by dates, storage, and allergen warnings — over anything the companion says.
• Use proper care with heat, sharp tools, hot oil, and raw or perishable foods. When the companion’s guidance conflicts with package instructions or your own senses, trust the packaging and your judgement.
• Supervise children and anyone who needs assistance in the kitchen.

4. Acceptable use

You agree to use the app only for lawful, personal purposes, and not to misuse, disrupt, reverse-engineer, or attempt to gain unauthorized access to the app or its servers, or to use it in any way that infringes others’ rights.

5. Subscriptions and payments

Simmernook is free to try, then requires a subscription to keep using the live cooking guidance.

Free trial. You get a small number of free guided cooks (currently 3) without any payment. After that, continuing the live cooking guidance requires an active Simmernook Plus subscription.

Plans. Simmernook Plus is an auto-renewable subscription, offered as:

• Monthly — $2.99 (USD) per month, or
• Yearly — $24.99 (USD) per year.

Prices are shown in U.S. dollars; the App Store displays your local price, which may differ, and prices may change (any change applies only to future billing periods).

Billing, renewal, and cancellation. Payment is charged to your Apple ID at confirmation of purchase. The subscription automatically renews at the same price unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within the 24 hours before the period ends. You can manage or cancel anytime in your App Store account settings. Cancelling stops the next renewal; the current period continues until it expires.

Processing and refunds. All purchases are processed by Apple and are subject to Apple’s terms. Refunds are handled by Apple under their policies (e.g., via reportaproblem.apple.com).

6. Intellectual property

The app, its design, and its content (other than recipe facts and your own conversations) are owned by us or our licensors. These Terms don’t grant you any rights to our trademarks or branding.

7. No warranty

The app is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, or uninterrupted availability. We do not warrant that the companionship will be correct or that the service will be error-free or always online (it depends on your internet connection and third-party AI services).

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for any loss arising from your use of (or inability to use) the app, including reliance on AI-generated guidance or any food prepared with the app. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

9. Changes to these Terms

We may update these Terms as the app evolves. We’ll revise the effective date above and, for material changes, provide notice in the app. Continued use after an update means you accept the revised Terms.

10. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. To the extent a dispute is not resolved informally, you and we agree to the exclusive jurisdiction of the state and federal courts located in New York, United States. Nothing in this section removes any mandatory consumer-protection rights you have under the laws of your own place of residence.
